The footboard is a steep climb above street level; there is no ramp, no kneeling mechanism, no space designated for a wheelchair inside. The bus stop itself lacks a tactile path. The nearest railway station has a lift – installed under Smart Cities funding – that has been out of service for four months, with no timeline for repairs. The journey, which for an able-bodied commuter is an inconvenience at worst, becomes, for a person with a locomotor disability, a calculation of dependency, risk, and humiliation. This is not an outlier. It is the structural reality that approximately 26 million persons with disabilities in India — a figure from the 2011 Census, widely considered an undercount — navigate every day. The question is not whether India has laws that promise accessible infrastructure. It does. The question is why those laws have produced so little change on the ground and what it would take to close that gap. The Legal Promise and Its Limits The Rights of Persons with Disabilities Act, 2016, replaced earlier legislation with stronger mandates. It requires all public buildings, transport systems, and government services to be accessible. It sets timelines and assigns responsibility to the union and state governments. On paper, it is a credible framework. In practice, it has been marked by the same failure pattern that afflicts much social legislation in India: ambitious text, underfunded implementation, and negligible enforcement. The Accessible India Campaign, launched in 2015 with the goal of making key government buildings, airports, and railway stations fully accessible by 2018, met its targets only selectively and partially. A 2019 audit by the Comptroller and Auditor General found that most audited railway stations lacked even basic features — functional ramps, accessible toilets, tactile flooring, and audio-visual passenger information systems. The audit was noted, reported, and largely set aside. Infrastructure That Excludes The problems span every layer of public infrastructure. Urban bus fleets across most Indian cities have no low-floor or kneeling buses in meaningful numbers. Bus stops lack shelters flush with the road, tactile paving, or Braille-enabled route information. Footpaths — where they exist — are routinely broken, encroached upon, and designed with kerbs that defeat wheelchair access. Metro systems, conceived as modern infrastructure, have performed better in some respects. Delhi Metro has lifts and tactile tiles across most stations. Yet the last-mile problem persists: the walk or ride from a metro exit to a destination frequently crosses broken pavements, unmarked pedestrian crossings without auditory signals, and public spaces with no ramp access. Accessibility does not end at the station gate. Public toilets present perhaps the starkest failure. A 2021 survey by the National Centre for Promotion of Employment for Disabled People across six Indian cities found that fewer than 10 per cent of public toilets met basic accessibility standards — wider cubicles, grab rails, lower washbasins, and step-free entry. In many cities, Swachh Bharat Mission-funded toilet blocks were built without consulting disability organisations, resulting in structures that are technically new but functionally inaccessible. Why States Fail The causes of this deficit are systemic rather than incidental. Accessibility is treated as an add-on — a retrofit after the primary design is finalised — rather than as a foundational requirement. This produces the familiar sight of a ramp bolted awkwardly onto a building entrance, at a gradient too steep for independent wheelchair use, or a "disabled toilet" positioned at the far end of a facility with no accessible path to reach it. Accountability is fragmented. Urban transport falls under one department, public works under another, and municipal sanitation under a third. No single authority owns the outcome. Monitoring mechanisms are weak: disability-impact audits are rarely conducted, and where conducted, their findings rarely trigger consequences. Civil society organisations working on disability rights note consistently that consultation with persons with disabilities is either absent or tokenistic — a box to tick rather than a genuine input into design. Budget allocations for accessibility retrofitting remain thin. Disability infrastructure is not a vote mobilising expenditure in the way that roads, housing, or electricity connections are perceived to be. This reflects a deeper failure: the political class has not internalised the view that accessible infrastructure is not welfare spending but the baseline cost of equitable public service. Lessons from East Asia Japan offers the most instructive counterpoint. The Act for Promoting Easy Mobility and Accessibility for the Elderly and Disabled Persons, passed in 2000 and strengthened in 2006, mandated barrier-free design as a condition of construction approval for public buildings and transport infrastructure. The result is visible in practice: Shinkansen coaches have designated wheelchair spaces with adjacent accessible toilets; urban stations have tactile guidance paths that are maintained and unobstructed; pedestrian crossings have auditory signals as a default; public toilet blocks have accessible cubicles that are cleaned and functional. South Korea has followed a comparable path. The Seoul metropolitan transit system has tactile maps at station entrances, lifts with Braille panels, and audio announcements as standard. Crucially, both countries enforced compliance through inspection regimes with penalties for non-performance. Accessibility was not left to the discretion of contractors or local officials; it was a legal condition with measurable indicators. The lesson is not merely technical. Both countries demonstrate that accessible design, when planned from the outset rather than retrofitted, costs marginally more and delivers infrastructure that benefits elderly citizens, parents with prams, and travellers with luggage – not only persons with disabilities. Universal design is not a special interest. It is good design. What Accountability Looks Like India requires three interlocking changes. First, accessibility standards must become non-negotiable conditions of infrastructure funding — no project should receive union or state disbursement without a certified accessibility audit at the design stage and again at completion. Second, a dedicated monitoring body with statutory powers, including the authority to impose financial penalties, must replace the current dispersed accountability across departments. Third, persons with disabilities must participate structurally in design review panels — not as consultees who may be ignored, but as members whose approval is required. Accessibility is neither charity nor aspiration. It is what a functioning democracy owes its citizens as a matter of law and of administrative competence. The gap between the Rights of Persons with Disabilities Act and the broken lift at a Chennai railway station is not a design failure. It is a governance failure. Closing it requires the same political seriousness that India brings to building expressways and airports — infrastructure that also, one notes, now routinely includes accessible restrooms for its paying users. The standard we apply to the powerful should not be higher than the standard we apply to the public.
